The Minister of Internal Affairs and Deputy Prime Minister, Ishmael Kalsakau, has signed an order on August 4 effectively varying and increasing fees for the sale or use of the State Flag, Presidential Standard (flag) or Armorial Bearings (such as Coat of Arms) based on the Applicant's annual returns.
This Order No. 126 of 2021 repeals clause 3 of a previous Order No. 102 that was signed in June last year by the minister.
Clause 3 outlines separate fees payable for permits, sale of items and the renewal of permit.
Clause 4 of the form was also amended to include a section for the applicant to include the most recent annual returns for their business.
In last year's Order, the application for a permit had a fee of VT50,000, fees for "application to sell or use in connection with any business, trade, calling or profession a copy of the State Flag, Presidential Standard or the Armorial Bearings or a thing so closely resembling any of them..." was also VT50,000, and the renewal permit was also VT50,000.
But in the amendment made this month, these fees have been amended to base on annual returns.
An applicant for a permit with an annual return of up to VT3 million pays a fee of VT50,000, but an applicant with an annual return of over VT3 million has a fee payable of VT100,000.
An application to sell or use in connection with any business, trade, calling or profession a copy of the State Flag, Presidential Standard or the Armorial Bearings or a thing so closely resembling any of them has a fee of VT50,000 for an applicant that has annual return of up to VT3 million.
But applicants with over VT3 million annual returns pays VT100,000.
There is similar structure of fees payable under renewal of permit based on annual returns up to VT3 million and over VT3 million.
This amendment was done by Minister Kalsakau under powers given to him by section 1A of the State Flag and Armorial Bearings Act (CAP 107).
State Flag and Armorial Bearings Act regulates the sale, display, possession, use in connection with any business or trade or profession "any copy of the State Flag, the Presidential Standard or the Armorial Bearings, or a thing so closely resembling any of them as to lead to the belief that the thing is one of them".
